If an employee is infected with tuberculosis at work, the case is recordable. This can be found in the regulations under 1904.5(b)(2), which provides exemptions from the assumption of work-relatedness. Paragraph (b)(2)(viii) exempts the common cold or flu, but notes that “contagious diseases such as tuberculosis, brucellosis, hepatitis A, or plague are considered work-related if the employee is infected at work.”
