Federal regulations
Georgia has adopted Part 395 of the Federal Regulations.
Applicability
Part 395 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Exception — Part 395 does not apply to drivers of covered farm vehicles as defined in Section 1-390.1 of the Georgia Department of Public Safety Transportation Rulebook that are transporting:
- Agricultural commodities to a location within a 150 air-mile radius of the source; or
- Farm supplies for agricultural purposes, from a wholesale or retail distribution point of the farm supplies to a farm or other location where the farm supplies are intended to be used within a 150 air-mile radius from the distribution point; or
- Farm supplies for agricultural purposes from a wholesale distribution point of the farm supplies to a retail distribution point of the farm supplies within a 150 air-mile radius from the wholesale distribution point.
Exception — Part 395 does not apply to drivers transporting agricultural commodities from the source of the agricultural commodities to a location within a 150 air-mile radius from the source, or farm supplies for agricultural purposes from a wholesale or retail distribution point of the farm supplies to a farm or other location where the farm supplies are intended to be used within a 150 air-mile radius from the distribution point, or farm supplies for agricultural purposes from a wholesale distribution point of the farm supplies to a retail distribution point of the farm supplies within a 150 air-mile radius from the wholesale distribution point when such transportation occurs during planting and harvesting seasons. Georgia’s planting and harvesting covers 365 days each year.
Electronic logging device (ELD)
As of January 1, 2019, a motor carrier operating solely in intrastate commerce must install and require each of its drivers to use an ELD.
An automatic on-board recording device, compliant with Sec. 395.15, installed prior to December 18, 2017, may be used until December 16, 2019. As of December 16, 2019, an ELD must be installed and used.
