One aspect of the new reporting rule targets employer programs and policies that, while nominally promoting safety, have the effect of discouraging workers from reporting injuries. This can include incentive programs. While the rule does not prohibit incentive programs, OSHA makes clear that they should encourage safe work practices and promote worker participation in safety-related activities.
As such, all employers should evaluate their current incentive program to ensure that the focus in on appropriately acknowledging and encouraging safe behavior.
