The state has passed the Texas Responsible Artificial Intelligence Governance Act (TRAIGA) into law, taking effect January 1, 2026. The law applies to developers (those who create and offer AI systems) and deployers (such as employers who use such systems to make hiring decisions).
The law prohibits developers and deployers from using AI systems with the intent to discriminate against protected classes of people. Unintentional bias or disproportionate outcomes do not in themselves constitute a violation; intent to discriminate must be shown.
Public employers have some additional restrictions, such as a ban on the use of social scoring and biometric data scraping (without consent).
Enforcement of the law is solely in the hands of the state Attorney General. There is no private right of action under TRAIGA.
