Yes. An employer may take employment action against or even terminate an employee on FMLA leave, as long as certain conditions are met. The employer must:
- Have an established substance abuse policy applied in a nondiscriminatory manner,
- State in the policy that under certain circumstances an employee may be terminated for substance abuse, and
- Have communicated the policy to all employees.
While you cannot take action against an employee because the employee has exercised the right to take FMLA leave for treatment, you may still terminate an employee taking leave for violating a company’s substance abuse policy.
