Can a driver hold a CDL and still claim the non-CDL, 150-air-mile exception?
Yes. Operators of property-carrying commercial motor vehicles not requiring a commercial driver’s license (CDL), as defined in 49 CFR Part 383, may be covered by the non-CDL 150 air-mile radius provision in 395.1(e)(2). Note that the applicability depends on the type of vehicle being driven, not whether the operator actually possesses a CDL.
