Each state manages used oil differently. Used oil is any petroleum-based or synthetic oil that has been used. Used oil handlers may manage the oil under EPA's used oil standards at 40 CFR 279 or they many manage it as a hazardous waste. If the handler has the capacity to store 1,320 gallons or more of used oil in containers of 55 gallons or more, then EPA's Spill Prevention, Containment, and Countermeasures (SPCC) rule also applies. Some states place more stringent regulations on used oil. Use the chart below to determine if additional requirements apply to your operations.
