Hawaii incorporates by reference most of the July 1, 2017, edition of the federal OSHA construction requirements for work zones; however, the state amends the 2017 edition at 29 CFR 1926.200(g)(2) to say that traffic control signs and devices must comply with Part VI of the December 2000 (Millennium) edition of the Manual of Uniform Traffic Control Devices (MUTCD). Hawaii also includes state-specific definitions for the terms “signs,” “signals,” and “barricades” in section (b)(1) of the 12-110-50 regulation.
As stated above, except as amended in section 12-110-50, HIOSH incorporates by reference the July 1, 2017, edition of 29 CFR 1926. Any new federal OSHA final rule that impacts work zone safety requirements and that took or takes effect after July 1, 2017, will not be effective until the state takes action. For example, currently, the federal OSHA Standards Improvement Project—Phase IV final rule, dated May 14, 2019, is not effective in Hawaii.
Note that some states have requirements for work zones and flaggers that fall under the state’s Department of Transportation regulations, in addition to the OSHA-related requirements listed here.
