Any driver of a commercial motor vehicle can qualify to use the 150-air-mile exception, as long as all the terms of the exception are met on the day when the exception is used. The exception is available to all types of drivers and vehicles, whether they are:
- Property-carrying or passenger-carrying,
- Empty or loaded,
- Large enough to require a commercial driver’s license or not, or
- Placarded for hazardous materials.
Among the terms that must be met (depending on vehicle type), the driver and/or company must:
- Have enough time off duty before the shift,
- Remain within 150 air miles,
- Return to the starting location at the end of the day,
- Stay within the driving limits,
- Be off duty and/or done driving within 14 consecutive hours, and
- Keep basic time records.
