29 CFR 1926.200(g)(2) indicates that construction areas (zones) must be protected by traffic control devices and that traffic control devices for the protection of construction workers must comply with Part 6 of the 2009 version (including 2012 revisions 1 and 2) of the Federal Highway Administration’s Manual on Uniform Traffic Control Devices for Streets and Highways (MUTCD).
Similarly, 29 CFR 1926.201(a) says that warning garments worn by flaggers shall conform to Part 6 of the 2009 version (including 2012 revisions 1 and 2) of the MUTCD.
Section 6D.03 of the MUTCD says, “… All workers, including emergency responders, within the right-of-way who are exposed either to traffic (vehicles using the highway for purposes of travel) or to work vehicles and construction equipment within the [Temporary Traffic Control (TTC)] zone shall wear high-visibility safety apparel that meets the Performance Class 2 or 3 requirements of the ANSI/ISEA 107–2004 publication entitled “American National Standard for High-Visibility Safety Apparel and Headwear” (see Section 1A.11), or equivalent revisions, and labeled as meeting the ANSI 107-2004 standard performance for Class 2 or 3 risk exposure, except as provided in Paragraph 5 [which is about emergency and incident responders and law enforcement personnel, not construction workers]. A person designated by the employer to be responsible for worker safety shall make the selection of the appropriate class of garment …”
Under nonmandatory Appendix B to ANSI/ISEA 107-2004:
- Class 1 apparel is used if the worker is paying full attention to traffic that is less than 25 miles per hour, and the worker is distanced from the traffic.
- Class 2 apparel is used if the worker is on a roadway with heavy traffic or traffic that is over 25 miles per hour. The apparel is also used when visibility is limited for road users or other hazards prohibit using Class 1 apparel.
- Class 3 apparel is used if the worker must be identifiable and visible to road users from a great distance, such as when traffic is over 50 miles per hour, when the worker is in highway construction, or the worker has exposure to varied weather. Class 3 apparel allows road users to see the worker from over 1,000 feet.
