The Labor Standards Division enforces all of the laws which have been enacted for the protection of Wyoming Workers. The Division:
- Processes, investigates, mediates, and renders decisions on complaints of employment discrimination and claims for wages.
- Provides information and referrals on wage, benefit, and employment decision matters to employees and employers.
- Monitors employment of minors.
- Issues certificates of residency to eligible contractors bidding on public works projects.
- Enforces the Prevailing Wage Act and resident labor preference requirements for public works projects.
- Licenses employment referral businesses within the state.
State Child Labor Laws: With some exceptions minors must be at least 14 years of age to be employed in Wyoming. The child labor law limits the work hours of minors under 16 years of age. With some exceptions, children under 16 are prohibited from employment in amusement, immoral, or dangerous pursuits. Hazardous types of employment are prohibited for persons under 18 years of age. Proof of age is required for minors under 16 years of age.

State Minimum Wage: $5.15 per hour. Effective April 1, 2001 and thereafter, all employers who employ tipped employees shall not pay less than two dollars and thirteen cents ($2.13) per hour to their tipped employees.

Overtime: State law provides time and one-half overtime pay for all laborers, workmen or mechanics employed upon any public works project of the state of Wyoming, or of any county, city, town or of any political subdivision thereof for work in excess of eight hours in a day, or 40 hours in one week.

State Prevailing Wage: $25,000 is set as the threshold amount for contract coverage under the state prevailing wage law.
