The Equal Rights Division administers and enforces civil rights and labor standards through the Civil Rights Bureau and the Labor Standards Bureau. The Labor Standards Bureau administers the following laws:
- Prevailing Wage Rate Laws
- Hours of Work and Overtime
- Records Open to Employee
- Restrictions on use of HIV Test
- One Day of Rest in Seven Law
- Street Trades
- Child Labor
- Minimum Wage
- Private Employment Agents
- Wage Payment and Collection
- Business Closing and Mass Layoffs
State Child Labor Laws: With some exceptions minors must be at least 14 years of age to be employed in Wisconsin. The child labor law limits the work hours and prohibits hazardous types of employment for persons under 18 years of age. Work permits are required for minors under 18 years of age.
The Wisconsin Child Labor Law can be found in Chapter 103, Sections 103.64 through 103.82 of the Wisconsin Annotated Statutes
State Minimum Wage: Effective July 24, 2009, the minimum wage for Wisconsin employees will be as follows:
- Adult (Non-agriculture): $7.25
- Minor (Non-agriculture): $7.25
- Opportunity Employee: $5.90
- Tipped Employee: $2.33
- Tipped Opportunity Employee: $2.13
- Adult (Agriculture): $7.25
- Minor (Agriculture): $7.25
The Wisconsin Minimum Wage Law can be found in Chapter 104, Sections 104.01 through 104.12 of the Wisconsin Annotated Statutes
Overtime: With some exceptions, Wisconsin employers must pay 1 1/2 times an employee's regular wage rate whenever an employee works more than 40 hours in any scheduled workweek.

State Prevailing Wage: The Wisconsin Department of Workforce Development determines the prevailing wage rates for all types of local and state public works projects. For state and municipal contracts, $168,000 is set as the threshold amount for contract coverage under the state prevailing wage law where more than one trade is involved, and $34,000 is the threshold amount where a single trade is involved. For state highway contracts, no threshold amount for contract coverage has been set under the state prevailing wage law.
