The Wage & Hour Section enforces the following Laws and/or Acts:
- Wage Payment and Collection (which includes wage bond provisions)
- Minimum Wage and Maximum Hours
- Contractor Licensing
- Wages for Construction of Public Improvements (prevailing wage)
- Child Labor
- Employment Agencies
- Parental Leave
- Equal Pay
State Child Labor Laws: The child labor law limits the work hours of minors under the age of 16 and prohibits hazardous types of employment for persons under 18 years of age. The Child Labor Law requires work permits for minors 14 and 15 years of age. Minors 16 and 17 years of age must obtain age certificates upon the request of the employer. A copy of the permit or certificate is forwarded to the Division of Labor.
The West Virginia Child Labor Law can be found in Chapter 21, Article 6, Sections 21-6-1 through 21-6-11 of the West Virginia Code.
State Minimum Wage: The West Virginia minimum wage is $8.75 per hour effective January 1, 2017.
West Virginia’s training wage increased to not less than $5.15 per hour beginning July 1, 2006.
Overtime: With some exceptions, West Virginia employers must pay 11/2 times an employee's regular wage rate whenever an employee works more than 40 hours in any scheduled workweek.
The West Virginia Minimum Wage and Maximum Hours Law can be found in Chapter 21, Article 5C, Sections 21-5C-1 through 21-5V-11 of the West Virginia Code.
State Prevailing Wage: Workmen employed by or on behalf of a public authority for construction of public improvements must be paid the prevailing hourly wage rate. The prevailing rates for all 55 counties are determined separately for each classification of work by the Commissioner on an annual basis. No threshold amount for contract coverage has been set under the state prevailing wage law.
