The Vermont Department of Labor and Industry enforces rules concerning minimum wage, overtime, wage payments, employee benefits, and child labor. The Wage and Hour Program also provides information on wage and employment-related issues and attempts to settle employer/employee wage and benefits disputes.
State Child Labor Laws: With some exceptions, minors under 14 years of age may not be employed. Child labor rules limit the work hours and prohibit hazardous types of employment for persons under 18 years of age. Generally, employment certificates are required for minors under the age of 16. Employers of minors must post a notice stating the minors' hours and meal break times.
Vermont rules on the employment of children can be found in Title 21, Chapter 5, Sections 431 to 453 of the Vermont Statutes Annotated
State Minimum Wage: Effective January 1, 2017, the minimum wage is $10.00 per hour. The state minimum wage will increase each January 1 to $10.50 in 2018. Starting on January 1 of 2019, the minimum wage rate will increase by five percent or the percentage increase of the Consumer Price Index. Also starting January 1, 2015, a tipped employee must be paid at least one-half the minimum wage.
Overtime: With exceptions, Vermont employers must pay 1 1/2 times an employee's regular wage rate whenever an employee works more than 40 hours in any scheduled workweek. The state overtime pay provision has very limited application because it exempts numerous types of establishments, such as retail and service; seasonal amusement/recreation; hotels, motels, restaurants; and transportation employees to whom the federal overtime provision does not apply.
Vermont rules on minimum wage and overtime can be found in Title 21, Chapter 5, Sections 381 to 384 of the Vermont Statutes Annotated
State Prevailing Wage: Vermont does not have a prevailing wage law.
