The Division of Labor and Management is responsible for enforcing wage and hour and child labor laws, answering questions about state and federal unemployment laws, and administering the state's workers' compensation system.
State Child Labor Laws: With some exceptions, minors under 14 years of age may not be employed. Child labor rules limit the work hours of persons 14 and 15 years old and prohibit the employment of persons under 18 years of age in occupations determined to be hazardous.
South Dakota rules on child labor can be found in Title 60, Chapter 60-12 of the South Dakota Codified Laws
State Minimum Wage: Effective January 1, 2017, the state minimum wage is $8.65 per hour. It will increase annually effective each January 1.

State Prevailing Wage: South Dakota does not have a prevailing wage law.
