The Bureau of Labor Law Compliance enforces laws covering state minimum wage and overtime requirements, working conditions, child labor, farm and forest labor contracting, and wage collection. The division also regulates the employment of workers on public works projects.
State Child Labor Laws: With some exceptions, minors under 14 years of age may not be employed or permitted to work in any occupation. Minors under the age of 18 must have an employment certificate. Minors 16 and 17 years of age may obtain a transferable work permit. Pennsylvania law prohibits work in some occupations and limits working hours for persons under the age of 18.
Pennsylvania's Child Labor Law can be found at Title 43, Sections 41 through 71 of the Pennsylvania Statutes
State Minimum Wage: The federal rate increased to $7.25 per hour on July 24, 2009. If the federal minimum wage increases above the Pennsylvania minimum wage, the state will automatically incorporate the federal rate.
Overtime: Most employees in Pennsylvania must be paid overtime compensation for any hours they work over 40 per week. Overtime compensation is 11/2 times the employee's straight time rate of pay.
Pennsylvania's Minimum Wage Act can be found at Title 43, Sections 333.101 through 333.115 of the Pennsylvania Statutes
State Prevailing Wage: $25,000 is set as the threshold amount for contract coverage under the state prevailing wage law. The Prevailing Wage Division, Bureau of Labor Law Compliance, Pennsylvania Department of Labor and Industry, determines prevailing wage rates for the construction industry and enforces the rates and classifications under heavy, highway, and building construction projects of $25,000 or more when public funds are involved.
Pennsylvania's Prevailing Wage Act can be found Title 43, Sections 165-1 through 165-17 of the Pennsylvania Statutes
