The Wage and Hour Bureau administers and enforces Ohio's Minimum Wage Laws, Ohio's Minor Labor Law, and Ohio's Prevailing Wage Law. The Bureau conducts workplace inspections, provides information to employers and employees, ensures compliance with labor laws, and investigates complaints. The Bureau also standardizes enforcement procedures and interprets the rules and regulations. If an employer grosses over $500,000 a year or is involved in interstate commerce, then the U.S. Department of Labor, Federal Wage & Hour Division has jurisdiction.
State Child Labor Laws: Ohio's Minor Labor Law applies to the employment of persons less than 18 years of age. Minors have limits on the allowable hours they can work. Every minor 14 to 18 years of age must have a work permit. Employers must prepare a written wage agreement, post a list of employed minors, and keep written records of minors' hours and rest periods. Wages may not be withheld from minors for shortages, presumed negligence, breakage of machinery, or incompetence. Minors under 16 years of age may not engage in door-to-door employment unless the for-profit employer is registered with the Ohio Department of Commerce, Division of Labor and Worker Safety, Wage and Hour Bureau. Certain occupations are considered hazardous to minors and minors are prohibited from working in those occupations.
Ohio rules for employment of minors can be found at Title 41, Chapter 4109 of the Ohio Revised Code.
State Minimum Wage: Effective January 1, 2017, Ohio’s minimum wage is $8.15 per hour for non-tipped employees and $4.07 for tipped employees. Also, the Ohio Minimum Wage is $7.25 per hour (tied to the federal minimum wage) for 14- and 15-year-olds, and for employers who gross $292,000 or less per year.
Ohio Minimum Fair Wage Standards can be found at Title 41, Chapter 4111 of the Ohio Revised Code.
State Prevailing Wage: The construction threshold level is $58,958.00, and the threshold level for reconstruction, enlargement, alteration, repair, remodeling, renovation, or painting is $17,687.00.
Ohio's rules on wages and hours on public works can be found at Title 41, Chapter 4115 of the Ohio Revised Code.
