The Labor and Industrial Division administers all state labor laws. These laws regulate hours of labor, payment of wages, employment of minors, and minimum wages. The Labor and Industrial Division also promotes apprenticeship programs and provides technical assistance and services to employers to assist in the establishment of apprenticeship programs. In addition, the division is responsible for establishing and enforcing prevailing wage levels for certain occupations employed in the state public works projects. The Labor and Industrial Division is comprised of the Apprenticeship Council Section, Public Works Bureau, Student Labor Section, and Wage and Hour Bureau.
State Child Labor Laws: With some exemptions, minors must be at least 14 years of age to be employed in the state of New Mexico. New Mexico law prohibits minors from working in some occupations. Working hours are limited for persons under the age of 16. Work permit certificates are required for minors under 16 years of age.
The Student Labor Section administers the Child Labor Act and investigates possible violations concerning minors. New Mexico rules on employment of minors can be found at Chapter 50, Article 6 of the New Mexico Statutes Annotated
State Minimum Wage: Effective January 1, 2009, the New Mexico minimum wage is $7.50 per hour.
Overtime: With some exceptions, New Mexico employers must pay 11/2 times an employee's regular wage rate whenever an employee works more than 40 hours in any scheduled workweek.
The Wage and Hour Bureau administers statutes concerning minimum wage, payment of wages, blacklisting, and overtime. The bureau also assists in enforcing the Public Works Minimum Wage Act in regard to wage and hour violations. State Prevailing Wage: $20,000 is set as the threshold amount for contract coverage under the state prevailing wage law. The Public Works Bureau administers the Public Works Minimum Wage Act and conducts wage surveys to determine the prevailing wage rates for each of four classifications of construction specified under that act. The bureau determines and issues the applicable minimum wage on all public works projects in the state in excess of $20,000 for construction, alteration, demolition, repair, painting, and decorating.
