Nebraska's Labor Laws include information concerning minimum wage, employee wage payment & collection, child labor, lunch periods, private employment agencies, contractor registration, non-English speaking employees, medical examinations, wage garnishments and other employment related laws.
State Child Labor Laws: With some exemptions, minors must be at least 14 years of age to be employed in the state of Nebraska. Minors under the age of 16 must obtain an Employment Certificate. Minors 14 and 15 years of age are not permitted to work more than 8 hours a day, 48 hours per week, before the hour of 6:00 a.m. or after the hour of 10:00 p.m. Federal law is more restrictive for minors under the age of 16. Compliance with Nebraska laws does not excuse non-compliance with other, more restrictive labor laws. When both laws apply, the more stringent standard must be observed.
The Nebraska Child Labor Law is found at Chapter 48, Part 301 of the Nebraska Revised Statutes.
State Minimum Wage: Effective January 1, 2016, the minimum wage for Nebraska employees is $9.00 per hour.
The Nebraska Wage and Hour Act (Minimum Wage) is found at Chapter 48, Part 1201 of the Nebraska Revised Statutes.
Overtime: Nebraska’s Wage & Hour Act does not have an overtime provision. Federal laws apply. An employer can make overtime hours mandatory. Assigning work-duties and hours of work is up to the employer’s discretion.
State Prevailing Wage: No threshold amount for contract coverage has been set under state law, except a threshold amount of $40,000 for projects let by public school districts.
