The Wage and Hour Unit of the Labor Standards Bureau enforces provisions of Montana's Wage Payment Act, minimum wage and overtime law, and the state Child Labor Standards Act. The Prevailing Wage function is also handled in the Labor Standards Bureau.
State Child Labor Laws: The Montana Child Labor law applies to all minors under 18 years of age, except for an individual who has received a high school diploma or equivalent or is 16 years of age or older and is enrolled in a registered state or federal apprenticeship program. The Montana Child Labor Laws apply to all minors, migrant as well as resident children. These laws do not supersede the federal child labor laws. The federal law is similar to the Montana law but is more restrictive in certain areas. The Montana Child Labor Standards Act of 1993 establishes the hours children may work and hazardous occupations in which they may not work - unless specifically exempted. Minors under 14 years of age may only be employed in certain specified jobs.

State Minimum Wage: Effective January 1, 2015, the state minimum is $8.05 per hour. The state minimum wage is adjusted each year according to the change in the federal Consumer Price Index (CPI) during the 12 months ending each August 31. No tip credit, meal credit, or training wage is allowed under Montana law.
However, if your business has annual gross sales of $110,000 or less and individual employees are not dealing with interstate commerce or otherwise covered by the federal Fair Labor Standards Act, the minimum wage is $4.00 per hour.
Overtime: Unless specifically exempt by Montana law, all employees must be paid at least 11/2 times their regular wages for all hours worked in excess of 40 hours in a workweek. Student employees of seasonal amusement or recreational areas (who are furnished board and room) must receive 11/2 times their regular wages for all hours worked in excess of 48 in any workweek.

State Prevailing Wage: Montana's prevailing wage law, also called Montana's Little Davis-Bacon Law, applies to public works contracts entered into for construction services (heavy, highway, and building) or non-construction services by the state, county, municipality, school district, or political subdivision in which the total cost of the contract is $25,000 or more involving public funds. It requires that bidders on contracts pay a set rate of compensation, including employee benefits, and that at least 50 percent of the workers on the jobs be bona fide Montana residents.
