State Child Labor Laws: The Minnesota Child Labor Laws prohibits work in hazardous occupations and limits working hours for persons under the age of 18. Proof of age must be maintained as part of the payroll records. An employment certificate is required for minors 14 and 15 years of age. A minor under age 14 may not be employed, except as a newspaper carrier (at least 11 years of age); in agriculture (at least 12 years of age with parental/guardian consent); as an actor, actress or model.
The Minnesota child labor requirements can be found in Chapter 181A, Sections 181A.01 through 181A.12 of the Minnesota Statutes.
State Minimum Wage: The minimum wage for Minnesota employees depends on whether the company is a “large employer” or a “small employer” as defined by annual business volume.
Tipped employees who receive gratuities through a debit, charge, credit card, or electronic payment must be credited to that pay period in which they are received by the employee. The full amount of such gratuity indicated in the payment must be distributed to the employee no later than the next scheduled pay period.
Overtime: The Minnesota Fair Labor Standards Act requires employers to pay overtime for all hours worked in excess of 48 per work week.
The Minnesota minimum wage and overtime requirements can be found in Chapter 177, Sections 177.01 through 177.44 of the Minnesota Statutes.
State Prevailing Wage: The threshold amount is $25,000 where more than one trade is involved; $2,500 where a single trade is involved.
The Minnesota prevailing wage requirements can be found in Chapter 177, Sections 177.41 through 177.44 of the Minnesota Statutes.
