The Wage and Hour Division administrates and enforces wage protection laws in Michigan (the Minimum Wage Act, the Payment of Wages and Fringe Benefits Act, the Youth Employment Standards Act, and the Prevailing Wages on State Projects Act). The division investigates complaints alleging non-payment of wages and fringe benefits, state minimum wage, overtime, equal pay, and prevailing wage disputes; and monitors youth employment standards including hours of work, and safe, non-hazardous working conditions. The Wage and Hour Division also educates employers and employees in the areas covered by these labor standards.
State Child Labor Laws: The Youth Employment Standards Act prohibits work in hazardous occupations and limits working hours for persons under the age of 18. Employees under 18 years of age must obtain a work permit or have their school complete a training agreement before starting work.
The Michigan Youth Employment Standards Act can be found in Chapter 409, Sections 101 through 409.124 of the Michigan Compiled Laws.
State Minimum Wage: The minimum wage for Michigan employees is $9.25 per hour. Starting in January 2019, the minimum wage will be adjusted each January 1 based on changes in the consumer price index.
New employees who are less than 20 years of age can be paid a training wage of $4.25 per hour for the first 90 days of employment. The minimum wage for employees under 18 years of age is 85 percent of the general minimum wage.
Overtime: Premium pay is required after 40 hours weekly.
The Michigan minimum wage and overtime requirements can be found in Chapter 408, Sections 408.411 through 408.424 of the Michigan Compiled Laws.
State Prevailing Wage: No threshold amount for contract coverage has been set under the state prevailing wage law.
The Michigan Prevailing Wages on State Projects Act can be found in Chapter 408, Sections 408.551 through 408.558 of the Michigan Compiled Laws.
