The Division of Occupational Safety is responsible for: several workplace safety and health programs, employment agency laws, prevailing wage schedules for many public works projects, and the state’s minimum wage regulations.
State Child Labor Laws: Massachusetts' Child Labor Laws restrict both the number of hours minors may work, and the occupations in which they may work. The Attorney General's Fair Labor and Business Practices Division investigates reports of violations of the child labor laws and of injuries or dangerous working conditions for young workers, and conducts targeted inspections in certain types of industries or in certain geographical areas. Generally, the work of minors is restricted with respect to three main areas. With very limited exceptions, minors under the age of fourteen may not be employed.
The Massachusetts child labor requirements can be found in Part I, Title XXI, Chapter 149, Sections 54 through 105 of the General Laws of Massachusetts.
State Minimum Wage: Effective January 1, 2017, the state minimum wage is $11.00 per hour. The minimum wage for tipped employees is $3.75.
Overtime: Premium pay is required after 40 hours weekly.
The Massachusetts minimum wage and overtime requirements can be found in Part I, Title XXI, Chapter 151 of the General Laws of Massachusetts.
State Prevailing Wage: No threshold amount for contract coverage has been set under the state prevailing wage law.
The Massachusetts prevailing wage requirements can be found in Part I, Title XXI, Chapter 149, Sections 27 through 27H of the General Laws of Massachusetts.
