The Kentucky Division of Employment Standards is responsible for laws regarding child labor, wage and hour, prevailing wage, and apprenticeship and training.
State Child Labor Laws: The Kentucky Child Labor Law regulates the employment of workers under 18 years of age. This law requires proof of age for minors between the ages of 14 and 17, limits work hours for workers under 18 years of age, and prohibits work in hazardous occupations for individuals under the age of 18. Workers under 18 years of age are also prohibited from working in pool or billiard rooms or in connection with any establishment where alcoholic liquors are distilled, rectified, compounded, brewed, manufactured, bottled, sold for consumption or dispensed unless permitted by the rules and regulations of the Alcoholic Beverage Control Board (except they may be employed in places where the sale of alcoholic beverages by the package is merely incidental to the main business actually conducted).
The Kentucky child labor requirements can be found in Title XXVII, Chapter 339 of the Kentucky Revised Statutes.
On June 15, 2002, new Child Labor Laws went into effect, tightening work hour restrictions to reflect the federal law.
These Child labor laws can be found in the Kentucky Administrative Regulations at Title 803, Chapter 1; 803 KAR 1:100.
State Minimum Wage: The minimum wage for Kentucky as of July 1, 2009, is $7.25 per hour.
The Kentucky minimum wage requirements can be found in Title XXVII, Chapter 337, Sections 337.275 through 337.410 of the Kentucky Revised Statutes.
Overtime: The 7th day overtime law, which is separate from the minimum wage law, differs in coverage from that in the minimum wage law and requires premium pay for those employees who have worked 40 hours in the six previous days.
Requirements for overtime compensation can be found in Title XXVII, Chapter 337, Sections 337.050 and 337.285 of the Kentucky Revised Statutes.
State Prevailing Wage: $250,000 is set as the threshold amount for contract coverage under the state prevailing wage law.
The Kentucky prevailing wage requirements can be found in Title XXVII, Chapter 337, Sections 337.505 through 337.550 of the Kentucky Revised Statutes.
