State Child Labor Laws: The Child Labor Law protects children by requiring employment certificates, prohibiting work in hazardous occupations, and limiting working hours. The employment certificate confirms that a minor is old enough to work, physically capable to perform the job, and that the job will not interfere with the minor's education. The Street Trades Law regulates the employment of minors in sales or other distributive service occupations.
The Illinois Child Labor Law can be found in Chapter 820, Article 205 of the Illinois Compiled Statutes:
State Minimum Wage: The minimum wage for Illinois employees is $8.25 per hour as of July 1, 2010. It is applicable to employers of 4 or more employees.
The Illinois Minimum Wage Law can be found in Chapter 820, Article 105 of the Illinois Compiled Statutes:
Overtime: Premium pay is required after 40 hours weekly.
Requirements for overtime compensation can be found in Chapter 820, Article 105, Section 820 ILCS 105/4a of the Illinois Compiled Statutes:
State Prevailing Wage: The Prevailing Wage Act requires contractors and subcontractors to pay laborers, workers, and mechanics employed on public works projects, no less than the general prevailing rate of wages for work of similar character in the locality where the work is performed. No threshold amount for contract coverage has been set under the state prevailing wage law.
Effective June 1, 2004, contractors are required to post prevailing wage rates at job sites.
