Massachusetts’ state requirements regarding used oil management include some regulatory information beyond the federal requirements and require “waste oil” to be regulated as hazardous waste. A summary of the additional requirements include the following:
- Waste oil accumulation areas must be marked, in letters at least one inch high, with “Waste Oil.”
- Waste oil generators must comply with the same containment requirements as other producers of hazardous waste.
- Drums must be kept separate from electrical areas.
- Spills in amounts of 10 gallons of oil or more must be immediately reported to MassDEP at (888) 304-1133.
- Generators who want to burn waste oil for heat must submit an On-Site Class A Recycling Notification Form to MassDEP.
- Shops that burn waste oil for heat must:
- Burn waste oil only between September 15 through June 15.
- Burn or transport at least 75 percent of all waste oil accumulated onsite during the same calendar year (this requires you to keep logs of the waste oil generated, transported, and received).
- Never modify space heaters.
