Summary of differences between federal and state regulations
Indiana has several labor relations laws regarding union activity in private sector employment; however, these are similar to the provisions provided in the National Labor Relations Act or Labor-Management Reporting and Disclosure Act.
Public employees
Indiana does have collective bargaining and labor relations laws for public workers and school workers.
Indiana granted state employees the right to union representation in 1990 under Executive Order 90-6. E.O. 90-6 divides most state employees into eleven different units, all of whom are eligible for union representation if the majority of the unit votes for representation.
Right to work
An Emergency Rule that went into effect on March 15, 2012, temporarily added provisions to establish procedures for right to work complaints for workers employed by private employers.
Employees may file a complaint alleging that, as a condition of employment, a person has required them to:
- become or remain a member of a labor organization,
- pay dues, fees, assessments, or other charges of any kind or amount to a labor organization,
- pay to a charity or third party an amount that is equivalent to or a part of dues, fees, assessments, or other charges required by labor organization members.
The complaint must be filed within 90 days of the date of the alleged violation.
