Overview
The Washington State Patrol has adopted the Federal Motor Carrier Safety Regulations, Parts 40, 325, 350, 355, 365, 367, 372, 373, 376, 379, 380, 381, 382, 383, 385, 387, 390-393 and 395-397 as they exist on October 1, 2023. This adoption is effective October 1, 2023.
The Utilities and Transportation Commission prescribes rules and regulations for carriers subject to its jurisdiction (household goods carriers, solid waste collection companies, and common carrier brokers) in the State of Washington. Effective July 19, 2024, the Utilities and Transportation Commission has adopted by reference the Federal Motor Carrier Safety Regulations as they were in effect on December 31, 2023. The regulations adopted (with some amendments) for intrastate carriers include Parts 40, 375, 379, 380,382, 383, 385, 390, 391, 392, 393, 395, 396, and 397.
Applicability
Included in the commercial motor vehicle definition adopted by the Washington State Patrol are vehicles with a gross vehicle weight rating or gross combination weight rating or gross weight or gross combination weight of 10,001 or more pounds and vehicles transporting hazardous materials requiring placards. However, motor carriers operating vehicles with a gross vehicle weight rating between 10,001 pounds and 26,000 pounds operating solely intrastate, and not transporting hazardous materials requiring placarding, are exempt from Part 391, Subparts D and E.
The Utilities and Transportation Commission adoption applies to all carriers subject to its jurisdiction that operate commercial motor vehicles as defined in Sec. 390.5.
