Overview
It is the duty of the Public Service Commission to establish rules and regulations governing the operations of motor carriers, including the development of rules for safety of operation and equipment. The PSC has adopted the U.S. Department of Transportation, Federal Motor Carrier Safety Regulations (FMCSRs) as amended or to be amended in the future insofar as they do not conflict with the laws of the State of Mississippi, Rules and Regulations of the State Tax Commission, and the Mississippi Highway Patrol.
Applicability
Parts 390-397 apply to commercial motor vehicles operated in intrastate commerce with a gross vehicle weight rating or gross combination weight rating of 26,001 pounds or more, or vehicles transporting a placardable amount of hazardous materials.
Exception — There are also exemptions, under certain conditions, for farmers, transportation of logs and pulpwood, and transportation of unmanufactured road building materials.
