Overview
The Michigan State Police is responsible for motor carrier safety regulations. The state adopted Parts 40, 356, 365, 368, 371-373, 375, 376, 379, 382, 383, 385, 387, 390-393, and 395-399 including the appendices of each part with some modifications.
Exempt intracity zones and the regulations applicable to exempt intracity zones do not apply.
Units of government and their employees must comply with §383.71(h) and Parts 382, 391, 392, and 393.
The regulations related to driver qualifications do not apply to utility, telephone, and cable television company service employees if those employees are not otherwise being used as regularly employed drivers and are not operating vehicles requiring a commercial driver’s license.
Applicability
The adopted regulations (with the exception of Parts 391, 392, and 393) apply to a vehicle defined as a commercial motor vehicle in §383.5. This definition includes a vehicle or combination of vehicles, operating in intrastate commerce with a gross combination weight or gross combination weight rating of 26,001 pounds or more inclusive of a towed unit(s) with a gross vehicle weight rating or gross vehicle weight of more than 10,000 pounds, whichever is greater; a gross vehicle weight rating or gross vehicle weight of 26,001 pounds or more, whichever is greater; or of any size and used in the transportation of hazardous materials.
Parts 391, 392, and 393 apply to an intrastate vehicle with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more (whichever is greater) or any size vehicle transporting a placardable amount of hazardous materials.
