Overview
The Kansas Corporation Commission is responsible for administering, enforcing and amending rules and regulations relative to motor carrier safety. The Corporation Commission has adopted certain parts of the Federal Motor Carrier Safety Regulations (FMCSRs) by reference as in effect on October 1, 2018. The Kansas Corporation Commission has adopted by reference (with some modifications) Parts 385, 386 Subpart F, 387, 390, 392, 397, 398, and 399.
The Kansas Corporation Commission has adopted by reference (with some modifications) Parts 40, 382, and 393 as in effect on October 1, 2022.
The Kansas Corporation Commission has adopted by reference (with some modifications) Part 391 as in effect on October 1, 2018, and as amended on September 30, 2019.
The Kansas Corporation Commission has adopted by reference (with some modifications) Part 395 as in effect on October 1, 2019, and as amended June 1, 2020, and in effect September 29, 2020.
The Kansas Corporation Commission has adopted by reference (with some modifications) Part 396, including Appendix A, as in effect on October 1, 2022.
Whenever the incorporated federal regulations refer to portions of the federal regulations that are not included above, the references will not be applicable unless otherwise specifically adopted.
Applicability
The adopted regulations apply to vehicles with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR), or gross vehicle weight (GVW) or gross combination weight (GCW) of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Private motor carriers domiciled in Kansas operating vehicles with a GVWR, GCWR, GVW, or GCW of 10,001 to 26,000 pounds are exempt from the majority of the adopted regulations. These operations must comply with Part 393, Subpart F (coupling devices), Part 393, Subpart I (load securement), and Sec. 396.17 (periodic/annual inspection). This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded.
