Overview
The Georgia Department of Motor Vehicle Safety has the authority to promulgate rules designed to promote safety of for-hire and private carriers. The Department has adopted Parts 350, 365, 376, 382, 383, 385, 386, 387, and 390-397 of the Federal Motor Carrier Safety Regulations with subsequent amendments. Some additional requirements or exceptions are also noted.
Applicability
This adoption applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Lightweight commercial motor vehicles, as defined in OCGA 40-1-1 are subject to and must comply with Secs. 391.11(b)(2), (3), (5), and (7); Part 392 except Secs. 392.8, 392.22, 392.62, and 392.63; Part 393 except Sec. 393.95; Part 396 except Secs. 396.3(b), 396.11, 396.13, 396.15, and 396.17.
A lightweight commercial motor vehicle is defined in OCGA 40-1-1 as a motor vehicle which does not meet the definition of a commercial motor vehicle and which, in the furtherance of a commercial enterprise is used to transport hazardous materials in a type or quantity for which placards are not required, is used to transport property or passengers (not taxicab) for compensation, or is a wrecker or tow truck.
