Individual states promulgate laws to comply with the federal law — The Personal Responsibility and Work Opportunity Reconciliation Act of 1996. This act is codified at 42 USC 653-653A. Employers need to only comply with state laws.
Montana Code Annotated §40-5-922 requires all employers to report within 20 days after hiring the employee. Reports transmitted electronically or magnetically may be made by two transmissions monthly, if necessary, not less than 12 or more than 16 days apart.
