Tennessee Department of Safety (DPS) has adopted the rules and regulations, as well as any amendments, supplements, or revisions contained within the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 100 – 180. This has been in effect since May 1974. The Tennessee DPS also adopted Part 397 of the Federal Motor Carrier Safety Regulations and all subsequent amendments, in effect since September 13, 1986.
The Tennessee DPS, Commercial Vehicle Enforcement (CVE), exercises regulatory control over the transportation of hazardous materials within the state.
The Department of Environment and Conservation, Division of Solid Waste Management (DSWM), is the lead agency in developing and administering the hazardous waste management program within Tennessee.
