Effective since October 1, 2000, the Kansas Corporation Commission incorporated by reference the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107.105, 107.502, 171 – 173, 177, 178, and 180 (except Section 171.7(a)(3)) as they existed on October 1, 2007. Part 397 of the Federal Motor Carrier Safety Regulations was incorporated by reference as in effect on October 1, 2011. Whenever the incorporated Federal Regulations refer to portions of the Federal Regulations that are not included, the references are not applicable.
The Kansas Corporation Commission (KCC) exercises regulatory control over the transportation of hazardous materials within the state.
The Kansas Department of Health and Environment (KDHE) is the lead agency in developing and administering the hazardous waste management program within Kansas.
