The Alaska Administrative Code requires that a person driving a commercial motor vehicle upon a highway or vehicular way and/or area must comply with the United States Department of Transportation (DOT) regulations regarding the transportation of hazardous materials. Alaska has adopted by reference the federal Hazardous Materials Regulations (HMR) and the Federal Motor Carrier Safety Regulations, Title 49, Code of Federal Regulations (CFR), Parts 100 – 199 and 200 – 999, as amended as of October 1, 1995. The Federal Regulations apply to any vehicular movement — regardless of the distance — within the state of Alaska.
The Alaska Department of Transportation and Public Facilities (DOT&PF) regulates the transportation of hazardous materials by highway within the state.
The Alaska Department of Environmental Conservation (DEC) is as the lead agency in developing the hazardous waste management program within Alaska. The state does not currently fund or staff a separate program, and no hazardous waste program within Alaska is currently approved. The United States Environmental Protection Agency (EPA) manages hazardous waste within Alaska and will continue to do so until Alaska’s Hazardous Waste Program is approved.
