Oregon has adopted Sec. 390.15 of the Federal Regulations, which includes accident recordkeeping requirements.
Applicability
Section 390.15 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Notification
You must file a Form 735-32 (Oregon Traffic Accident and Insurance Report) with DMV within 72 hours when:
- Damage to the vehicle you were driving is over $2,500, or
- Damage to any vehicle is over $2,500 and any vehicle is towed from the scene as a result of damages from this accident, or
- Injury or death resulted from this accident, or
- Damages to any one person’s property other than a vehicle involved in this accident is over $2,500.
When an accident involving a fatality occurs, the motor carrier must notify ODOT within 24 hours of learning of the fatality. Notification should be made by telephone (503) 986-3507, or by FAX (503) 986-4249. The following information must be conveyed:
- Date and time of the accident,
- Location of the accident,
- Name of each carrier involved,
- Number of persons killed,
- Brief description of accident, and
- Name and telephone number of the person reporting.
The motor carrier must submit Form 735-9229 (Motor Carrier Crash Report) with Form 735-32 (Oregon Traffic Accident and Insurance Report). Form 735-9229 is required when a fatality occurs within 30 days of the accident, any person involved sustains injury requiring treatment away from the scene, or any vehicle involved requires towing. Form 735-9229 and Form 735-32 must be submitted to the ODOT DMV Accident Reporting Unit, 1905 Lana Ave., NE, Salem, OR 97314. Supplies of Form 735-9229 and Form 735-32 are available by telephone request to (503) 945-5098.
How to obtain accident reports
Procedure
Copies of an individual’s Oregon Traffic Accident and Insurance Report are not available. Information contained in the report, including the identity of the owner, driver, occupants, vehicle registration number, insurance information, and the names of witnesses are available to any person involved in the accident, the person’s family, or the person’s personal representative. Information is provided in letter form.
A Certificate of Filing is available at no charge to those persons who have, or claim to have, filed an Oregon Traffic Accident and Insurance Report with the Department of Motor Vehicles.
Fee
The fee is $12.50; $13.50 for a certified letter.
