New York has adopted the accident recordkeeping requirements in Sec. 390.15 of the Federal Regulations.
Applicability
Section 390.15 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Notification
Every person operating a motor vehicle which is involved in an accident in the state of New York, in which there is property damage in excess of $1,000, or someone is injured or killed, must within 10 days after such accident, file form MV-104. This form is available via the DMV website: https://roar-assets-auto.rbl.ms/documents/56022/mv104.pdf
If a person is injured or killed, you are required by the NYS Vehicle and Traffic Law to immediately notify the police. All the involved drivers and the police must file an accident report with the DMV.
This report is required of carriers engaged in either interstate or intrastate operations.
Failure to file an accident report may result in the suspension of the driver’s license.
All Department of Motor Vehicle forms must be forwarded to the Crash Records Center.
How to obtain accident reports
Procedure
A copy of an official accident report may be obtained by calling or visiting the local police agency or precinct where the accident occurred. If the police and/or motorists’ reports have already been filed and processed by the DMV, you can use the online Order and Access Accident Reports transaction (https://dmv.ny.gov/records/order-and-access-motor-vehicle-accident-reports) to locate and access PDF copies of the reports. The Department keeps accident records on file for four years.
Fees
The fee for each online accident report search is $7.00 and the fee for each report search via mail is $10.00. The search fee is not refundable. If found, the fee for a single copy of the report is $15.00.
