Federal regulations
New Mexico has adopted Sec. 390.15 of the Federal Regulations, which includes accident recordkeeping requirements.
Applicability
Section 390.15 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
Notification
The driver of a vehicle involved in an accident resulting in bodily injury to or death of any person or property damage to an apparent extent of $500.00 or more shall notify police immediately. Within 5 days after the accident, a written report of such accident shall be made to the State Highway and Transportation Department.
