Montana has adopted Sec. 390.15 of the Federal Regulations, which includes accident recordkeeping requirements.
Applicability
Section 390.15 applies to intrastate operation of vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds, or vehicles used to transport hazardous materials of a type or quantity that require the vehicle to be placarded.
Notification
If physically capable, the driver of any vehicle involved in an accident resulting in bodily injury to or death of any person or total property damage to an apparent extent of $500 or more shall immediately notify the nearest police authority. In case of injury, death or property damage to one person’s property in excess of $1,000, a written report shall be filed to the Accident Records Department of the Montana Highway Patrol within 10 days. In the event the driver is physically incapable of making such report, another occupant or the owner shall submit a written report within ten days after learning of such accident. If an officer investigated the accident, no written report is necessary.
How to obtain accident reports
Procedure
A “Crash Release Form” (HQ1511) must be completed. The form is available via the Montana Highway Patrol website: https://dojmt.gov/highwaypatrol/crash-records/
Fee
The fee for a copy of the report is $2.00.
