Kansas has adopted Sec. 390.15 of the Federal Regulations, which includes accident recordkeeping requirements.
Applicability
Section 390.15 applies to vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Exception — Private motor carriers domiciled in Kansas operating vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 to 26,000 pounds are exempt from compliance with Sec. 390.15. This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded.
Immediate notice
The driver of a vehicle involved in an accident resulting in injury to or death of any person or total damage to all property to an apparent extent of $1,000 or more shall give notice immediately of such accident, by the quickest means of communication, to the nearest office of a duly authorized police authority.
Whenever the driver of a vehicle is physically incapable of giving an immediate notice of an accident as required above and there was another occupant in the vehicle at the time of the accident capable of doing so, such occupant shall make or cause to be given the notice not given by the driver.
How to obtain accident reports
Procedure
A copy of an accident report may be obtained in person, or by sending a request in writing, accompanied by the required fee, to the State Highway Patrol.
A copy of an accident report may be obtained online at: https://www.kansas.gov/accident-reports/.
Fee
$5.00 for each accident report.
