South Dakota has adopted Sec. 390.15 of the Federal regulations, which includes accident recordkeeping requirements.
Applicability
Sec. 390.15 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.
Notification
The driver of any vehicle involved in an accident resulting in injury or death to any person or property damage to an apparent extent of $1,000 or more to any one person’s property, or $2,000 per accident, shall immediately notify the nearest peace officer who has jurisdiction.
How to obtain accident reports
Procedure
A copy of an official accident report may be obtained by completing an “Accident Report Request” form. The form is available via the South Dakota Office of Highway Safety website: http://safesd.gov. An accident report may also be obtained electronically via the same website.
Fee
$4.00 for each report. There us a $6.00 convenience fee to purchase a report online.
