Wisconsin has adopted Part 391 with the exception of Sec. 391.11(b)(1) and Sec. 391.41(b)(10) (in certain situations) for intrastate drivers.
Applicability
Part 391 applies to drivers who operate motor vehicles with a gross vehicle weight rating over 26,000 pounds, and drivers operating vehicles of any size transporting a placardable amount of hazardous materials.
Age
Sec. 391.11(b)(1) was not adopted. An intrastate driver must be 18 years of age.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There are exceptions to the physical qualification requirement. See Physical Qualification below.
Operator’s license
The license classes are as follows:
Class | Description |
---|---|
Class A | Any combination of vehicles with a gross vehicle weight rating, actual gross weight or registered weight of over 26,000 pounds, if the aggregate total gross vehicle weight rating, actual gross weight or registered weight of the vehicle or vehicles being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a gross vehicle weight rating, actual gross weight or registered weight of over 26,000 pounds, and any such vehicle towing a vehicle or vehicles with an aggregate total gross vehicle weight rating, actual gross weight or registered weight of 10,000 pounds or less. |
Class C | Any single vehicle with a gross vehicle weight rating, actual gross weight and registered weight of 26,000 pounds or less, including any such vehicle towing a vehicle with a gross vehicle weight rating, actual gross weight and registered weight of less than 10,000 pounds, if any of the following applies: 1. The vehicle is designed to transport 16 or more passengers, including the driver. 2. The vehicle is transporting hazardous materials requiring placarding or any quantity of a material listed as a select agent or toxin under 42 CFR 73. |
Class D | Class D licenses are for operation of all other vehicles not described in class A, B, C, or M, including regular cars and light trucks. |
Class M | Class M licenses are for operation of type 1 motorcycles. |

Physical qualification
Grandfather Provision — A grandfather provision was established for intrastate drivers who have met state medical qualifications and have been issued a valid Wisconsin commercial driver’s license or CDL prior to July 29, 1996, which has not been revoked or cancelled, and who continue to meet state medical requirements as found in Chapter Trans 112.
Exemption — A driver may apply (with the Department of Transportation) for an exemption from Sec. 391.41(b)(10) (vision standards).
