West Virginia has adopted Part 391 of the Federal Regulations with some modifications.
Part 391 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
The allowable age to operate a heavy truck in intrastate operations is 18.
A driver qualification file (Sec. 391.51) is required.
The license classes currently are as follows:
|Class A||Any combination of vehicles with a GCWR of 26,001 or more pounds provided the GVWR of the vehicle being towed is in excess of 10,000 pounds.|
|Class B||Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing a vehicle not in excess of 10,000 pounds.|
|Class C||Any single vehicle, or combination of vehicles, that do not meet the definition of Class A or Class B, but that either is designated to transport 16 or more passengers including the driver, or is placarded for hazardous materials.|
|Class D||A person whose primary function of employment is the transportation of people or property for compensation or wages and who does not meet the requirements for a Class A, B, or C license.|
|Class E||Represents a driver’s license for automobiles and small trucks which are used for personal and private use (non-commercial).|
|T||Authorizes driving double and triple trailers.|
|P||Authorizes driving vehicles carrying passengers.|
|N||Authorizes driving tank vehicles.|
|H||Authorizes the driver to drive a vehicle transporting hazardous materials.|
|F||Authorizes the driver to operate a motorcycle while holding a Class A, B, C, D or E driver’s license.|
