Federal regulations
West Virginia has adopted Part 391 of the Federal Regulations with some modifications.
Applicability
Part 391 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Age
The allowable age to operate a heavy truck in intrastate operations is 18.
Driver qualification file
A driver qualification file (Sec. 391.51) is required.
Operator’s license
The license classes currently are as follows:
Class | Description |
Class A | Any combination of vehicles with a GCWR of 26,001 or more pounds provided the GVWR of the vehicle being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing a vehicle not in excess of 10,000 pounds. |
Class C | Any single vehicle, or combination of vehicles, that do not meet the definition of Class A or Class B, but that either is designated to transport 16 or more passengers including the driver, or is placarded for hazardous materials. |
Class D | A person whose primary function of employment is the transportation of people or property for compensation or wages and who does not meet the requirements for a Class A, B, or C license. |
Class E | Represents a driver’s license for automobiles and small trucks which are used for personal and private use (non-commercial). |
Endorsements | |
T | Authorizes driving double and triple trailers. |
P | Authorizes driving vehicles carrying passengers. |
S | School bus. |
N | Authorizes driving tank vehicles. |
H | Authorizes the driver to drive a vehicle transporting hazardous materials. |
X | Tank/hazardous materials. |
F | Authorizes the driver to operate a motorcycle while holding a Class A, B, C, D or E driver’s license. |
