South Dakota has adopted Part 391 of the Federal Regulations with some modifications.
Applicability
Part 391 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.
Age
18 years of age for an intrastate driver not transporting hazardous materials of a type or quantity requiring placarding. 21 years of age for an intrastate driver transporting hazardous materials of a type or quantity requiring placarding or an interstate driver.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification below.
Operator’s license
The following classification system is now in effect:
Class | Description |
A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 or more pounds, provided the gross vehicle weight rating (GVWR) of vehicle being towed is in excess of 10,000 pounds. |
B | Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another vehicle not in excess of 10,000 pounds GVWR. |
C | Any single vehicle with a GVWR less than 26,001 pounds, or any such vehicle towing another vehicle not in excess of 10,000 pounds GVWR. Includes vehicles designed to carry 16 or more passengers (including the driver) or vehicles used to transport hazardous materials in quantities requiring placarding. |

Physical qualification
Intrastate drivers are exempt from the physical requirements of Sec. 391.41.
