North Carolina has adopted Part 391 with the exception of Sec. 391.11(b)(1)for intrastate drivers not transporting hazardous materials.
Applicability
Part 391 applies to all intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 pounds or more, whichever is greater, and any vehicles transporting hazardous materials required to be placarded.
Age
A driver must be 21 to obtain a commercial Class A, B, or C license. Intrastate drivers may obtain a CDL at age 18 if not transporting hazardous materials. However, the driver must first be reviewed by the Exemption Review Board.
Alcohol and drug testing
An employer must report all employee or applicant positive drug or alcohol test results and all employee refusals to participate in a drug or alcohol test under 49 CFR Part 382 or Part 655 to the Division of Motor Vehicles (DMV). The notification must be in writing and submitted within five business days of the employer’s receipt of confirmation of a positive test or refusal to participate in the test.
When DMV receives a report of a positive drug or alcohol test or refusal to participate in a drug or alcohol test, the driver will be disqualified from driving a commercial motor vehicle until he/she presents proof of successful completion of assessment and treatment by a substance abuse professional in accordance with Sec. 382.503. The driver will be notified of this disqualification by DMV and will have 20 days from the date of notice to request a hearing.
The notice of disqualification will be placed on the driver’s driving record and will remain on the driving record for two years following the end of the driver’s disqualification.
A “Positive Drug Test Report for Current Employee” (CDL-8) form may be obtained via the DMV’s website: www.ncdot.gov/dmv/forms/.

A driver qualification file (Sec. 391.51) is required.
Operator’s license
North Carolina’s commercial driver’s license classification system is as follows:
Class | Description |
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more, provided the gross vehicle weight rating (GVWR) of the vehicle or vehicles being towed is 10,001 pounds or greater. |
Class B | Any single vehicle with a GVWR of 26,001 pounds or more and any such vehicle towing a vehicle with a GVWR less than 10,001 pounds. |
Class C | Any single vehicle or combination vehicle not included within Class Aor B above, which is:

H | Authorizes driving a vehicle transporting hazardous materials. |
T | Authorizes driving double trailers. |
P | Authorizes driving vehicles carrying passengers. |
N | Authorizes driving tank vehicles. |

M | Authorizes driving a motorcycle. (Motorcycle operation requires an endorsement on any class of license) |

The classified system for operators driving vehicles which do not require a CDLis as follows: | |
Class | Description |
Class A (classified) | Has a combined GVWR of at least 26,001 pounds and includes as part of the combination a towed unit that has a GVWR of at least 10,001 pounds; or has a combined GVWR of less than 26,001 pounds and includes as part of the combination a towed unit that has a GVWR of at least 10,001 pounds. |
Class B (classified) | A single motor vehicle that has a GVWR of at least 26,001 pounds; or a combination of motor vehicles that includes as part of the combination a towing unit that has a GVWR of at least 26,001 pounds and a towed unit that has a GVWR of less than 10,001 pounds. |
Class C (classified) | Necessary to drive any vehicle or combination of vehicles which are exempt from commercial or classified Class A or B licenses. This includes vehicles which carry up to 15 passengers including the driver, and are not hauling hazardous materials. |
Motorcycle Endorsement | Required on any class of license to operate a motorcycle. |
