Federal regulations
New Mexico has adopted Part 391 of the Federal Regulations with some exceptions.
Applicability
Part 391 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
Age
Intrastate drivers hauling hazardous materials requiring placards must be 21; to transport nonhazardous materials, intrastate drivers must be 18.
Alcohol and Drug Testing
A person or entity who is subject to Sec. 382.103 must report positive test results or a refusal to submit to a test to the Motor Vehicle Division of the Taxation and Revenue Department.
The Motor Vehicle Division must enter the report of a positive test result or refusal to submit to a test on the reported person’s motor vehicle record. The Motor Vehicle Division must keep the report of a positive test result or a refusal to submit to a test in the motor vehicle record of the driver for five years from the time the report was received by the Motor Vehicle Division.
Driver qualification file
A driver qualification file (Sec. 391.51) is required.
Operator’s license
The current classification system is as follows:
Class | Description |
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more, providing the GCWR of the vehicle(s) being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a gross vehicle weight rating (GVWR) of 26,001 pounds or more and any such vehicle towing a vehicle not in excess of 10,000 pounds GVWR. |
Class C | Any single vehicle that does not meet either the definition of Class A or Class B but is used in the transportation of hazardous materials, which requires the vehicle to be placarded under applicable law or designed to transport 16 or more passengers including driver. |
Class D | A license to drive any single vehicle weighing less than 26,001 pounds and vehicles towing 10,000 pounds or less. |
