Federal regulations
New Hampshire has adopted Part 391 of the Federal Regulations with some exceptions.
Applicability
Part 391 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Age
Minimum age (intrastate) for non-hazardous materials, non-hazardous substances, or non-hazardous wastes is 18; for hazardous materials, hazardous substances, or hazardous wastes 21.
A person 18 years old on or before January 1, 2011, may make intrastate retail deliveries of home heating oil. After January 1, 2011, a person must be 21 years old to make intrastate retail deliveries of home heating oil.
Drivers operating interstate must be 21.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There are exceptions to the physical qualification requirement. See Physical Qualification below for details.
Operator’s license
The new commercial license classes and endorsements are described as follows:
*In N.H. - (As of September 3, 1991) Any combination of vehicles over 26,000 pounds either not hooked by a fifth wheel or straight truck towing a trailer with electric brakes. | |
Class | Description |
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 or more pounds provided the gross vehicle weight rating (GVWR) of the vehicle(s) being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing a vehicle not in excess of 10,000 pounds GVWR. |
Class C | Any single vehicle or combination of vehicles that is less than 26,001 pounds GVWR, that is placarded for hazardous materials or designed to transport 16 or more persons, including the operator. |
Class D | Operator's license. A vehicle with a gross vehicle weight of up to and including 26,000 pounds provided the gross weight of any vehicle being towed is not in excess of 10,000 pounds. |

Physical qualification
A person who is not physically qualified to drive may apply for a waiver with the New Hampshire Department of Safety.
