Federal regulations
Montana has adopted Part 391 of the Federal Regulations with the exception of Sec. 391.11(b)(1).
Applicability
Part 391 applies to intrastate operation of vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds, or vehicles used to transport hazardous materials of a type or quantity that require the vehicle to be placarded.
Age
21 for interstate operations, 18 for intrastate operations.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There are exceptions to the physical qualification requirement. See Physical Qualification below for details.
Operator’s license
The commercial driver’s license classifications are as follows:
Class | Description |
---|---|
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more provided the gross vehicle weight rating (GVWR) of the vehicle(s) being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a GVWR of 26,001 pounds or more or any such vehicle towing a vehicle not in excess of 10,000 pounds GVWR. |
Class C | Any single vehicle, or combination of vehicles, that meets neither the definition of Class A nor that of Class B, but that either is designed to transport 16 or more passengers including the driver, or is used to transport a placardable amount of hazardous materials. |
Class D | Any noncommercial vehicle authorized to be driven with a regular driver’s license. |
Class M | Motorcycles, motor-driven cycles. |
Endorsements | |
N | Tank vehicle. |
H | Hazardous materials. |
T | Double/triple trailers. |
X | Combination of tank vehicle and hazardous materials endorsements. |
P | Passenger. |
S | School bus. |
Physical qualification
Waivers of certain physical qualifications may be granted if prescribed criteria are met.
Exception — Part 391, Subpart E does not apply to the operation of a covered farm vehicle.
