Michigan has adopted Part 391 with some modifications.
Applicability
Part 391 applies to an intrastate vehicle with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more (whichever is greater), or any size vehicle transporting a placardable amount of hazardous materials.
Utility Exception — The regulations related to driver qualifications do not apply to utility, telephone, and cable television company service employees if those employees are not otherwise being used as regularly employed drivers and are not operating vehicles requiring a commercial driver’s license.
Farm Vehicle Driver Exceptions — Farm vehicle drivers as defined in §390.5 are not subject to §§391.21, 391.23, 391.31, 391.41 to 391.45 to the extent that they require a driver to be medically qualified or examined and to have a medical examiner’s certificate, and the maintenance of files and records.
Age
A commercial motor vehicle operator must be at least 18 years of age, 21 if transporting hazardous materials in a marked or placarded vehicle.
Driver qualification file
A driver qualification file (Sec. 391.51) is required.
Operator’s license
The base licenses are an operator’s license and chauffeur’s license. A chauffeur’s license is needed if the driver:
- is employed for the principal purpose of operating a motor vehicle with a GVWR of 10,000 pounds or more;
- operates a motor vehicle as a carrier of passengers or as a common or contract carrier of property; or
- operates a bus, school bus, pupil transportation vehicle, taxi or limousine.
The designations for commercial driver’s license classes and endorsements are as follows for Michigan residents:
Class | Description |

Group A CDL | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 pounds or more, provided with the gross vehicle weight rating (GVWR) of the vehicle or vehicles being towed is in excess of 10,000 pounds. |
Group B CDL | A single vehicle with a GVWR of 26,001 pounds or more or any such vehicle towing a vehicle with a GVWR of not more than 10,000 pounds. |
Group C CDL | A single vehicle with less than 26,001 pounds GVWR or GCWR, and the vehicle being towed does not have a GVWR over 10,000 pounds, or is designed to carry 16 or more people (including the driver), or carries hazardous materials in amounts requiring placarding. |

Physical qualification
A person who is not physically qualified to drive under §391.41 may apply for a waiver. A joint application from the driver and motor carrier needs to be made to the Medical Waiver Unit of the Michigan State Police Commercial Vehicle Enforcement Division.
